This chapter describes the moral rights regime contained in the Australian Copyright Act 1968 (Cth), with particular attention to considerations such as: their historical background, Australia's membership of relevant international conventions, the beneficiaries of the protection of moral rights, the nature and operation of the rights, and exceptions to moral rights protection. Both authors' and performers' moral rights are addressed. The chapter has been updated since the first edition of this book and discusses the most recent court decisions which elucidate the legislative provisions.
