The definition and discovery of facts in native title: the historian’s contribution

Historians' contribution to proving the material facts in native title claims is examined. The role of historians in assisting courts in their estimation of the past is discussed. Specifically, the article explores, in an evidentiary context, how interpretations of history can influence evidence needed to find native title proved on the balance of probabilities.
