Through this submission, Deakin University contributes to the Australian Government Office of the National Data Commissioner’s invitation to submit its comments on the Data Availability and Transparency Bill Exposure Draft and Explanatory Memorandum. Deakin University’s submission focuses on the compatibility of some of the proposed Bill’s legal requirements and definitions with the Bill’s aims, namely, to enhance public sector data availability and transparency, as well as to build confidence in the use of public sector data. While Deakin supports the National Data Commissioner’s overarching effort to enhance data availability and data sharing across public sector entities, we have identified three broad areas in which some improvement of the proposed legal arrangements are advised. These include: (i) encouraging public trust in data sharing regimes through meaningful transparency concerning data sharing activities, in a form accessible to the Australian public (ii) enhancing the availability of public sector data to the Australian society as a whole (iii) harmonising core data governance definitions to clarify data sharing roles and responsibilities. Under each of these broad themes, we propose several concrete recommendations designed to improve the proposed legal regime’s efficacy and social benefit.Publication classification
