This report examines the interaction between problem gambling and the criminal justice system. The report aims to consider the merits, and evaluate the prospective effectiveness, range of sentencing options and access the ability and effectiveness of improving data collection in courts and prison. Five sources of information, including court data are included to investigate the prevalence of gambling-related offending. The findings revealed that in general, gambling is not regarded as a mitigating factor for sentencing by the courts. Other findings include that there are no formal mechanisms to issue a rehabilitative sentence for individuals suffering from gambling at the time of offence. Recommendations are provided regarding sentencing.Publication classification
