Vulnerable Adults, Law and Virtue Jurisprudence in the Victorian Civil and Administrative Tribunal and in the Court of Protection in England and Wales

A comparative study of the Guardianship List of the Victorian Civil and Administrative Tribunal, its practices and case law, with the Court of Protection in England and Wales. This study through the lens of virtue jurisprudence, focuses in particular on vulnerable adults whose primary diagnosis is dementia. The study observes that while many vulnerable adults with dementia are not necessarily incompetent and still retain some decision making capacity, many remain very vulnerable to exploitation under current Victoria law.
